Effective November 6, 2026 · Version 2026-11-06
1. Agreement and scope of service
These Terms and Conditions and Service Agreement govern your access to Contractor Profit Audit (the Service), including its website, accounts, audits, reports, maps, calculators, AI answers, and recommendations. ‘We,’ ‘us,’ and ‘our’ refer to the operator of Contractor Profit Audit, including its site owner and administrator. ‘You’ refers to you and, if you act for a business, that business. By using the Service you accept these terms; by subscribing you also expressly accept the recurring billing and cancellation provisions below. You must be at least 18 and authorized to bind any business you represent.
The Service is a decision-support tool, not a substitute for your independent judgment, field inspections, professional advice, or knowledge of your business. It does not provide legal, financial, tax, accounting, engineering, safety, or other licensed professional advice. No professional-client or fiduciary relationship is created.
2. Mistakes, estimates, and required independent review
Like any human or AI tool, the Service is susceptible to mistakes. AI may produce plausible but incorrect, incomplete, inconsistent, or outdated answers. Uploaded data, parsing, assumptions, calculations, geocoding, maps, estimates, reports, and recommendations may contain errors or omit material information. Results are not guarantees of accuracy, savings, revenue, profit, efficiency, coverage, or suitability for any particular purpose.
You must carefully assess every report and recommendation in light of your real-world knowledge of your operational nuances, customers, and service area(s). Verify source data, formulas, assumptions, costs, travel conditions, job complexity, technician capabilities, contractual obligations, local conditions, and applicable laws before relying on or implementing any result. Obtain qualified professional advice where appropriate. Coverage circles are illustrative ZIP-centered indicators, not exact service boundaries or actual vehicle routes.
You remain solely responsible for decisions involving pricing, staffing, dispatch, customer service, service territories, contracts, finances, safety, and compliance, and for the consequences of acting or declining to act on any output. Do not use the Service as the sole basis for a safety-critical, regulated, legal, or financial decision.
3. Your account and data
Keep account credentials secure and provide accurate account and billing information. Upload only data you are entitled to process and ensure you have any required customer or employee permissions. Do not submit sensitive personal information, confidential customer details, or credentials in AI questions. Uploaded job files are analyzed on your device; selected account and report information and conversations may be stored to support features, and allowlisted aggregate summaries are shared when you request AI analysis. Third-party payment and mapping providers process information needed for their services.
You may not misuse the Service, attempt unauthorized access, interfere with its operation, circumvent payment or access controls, or use it unlawfully. You retain rights to your data; you authorize the processing necessary to provide the features you request. Availability and third-party services may be interrupted or changed; continuous access is not guaranteed.
4. Fees and automatic monthly renewal
One-time report purchases and monthly subscriptions have the prices and access periods displayed at checkout, plus any applicable taxes. A monthly subscription automatically renews each month and your selected payment method is charged for each new billing period unless you cancel before the renewal is processed. By subscribing, you authorize these recurring charges until cancellation. The checkout total controls the amount payable. Any future price change will be disclosed before it applies, with an opportunity to cancel.
Initial subscription payment requires you to scroll through this entire agreement and affirmatively agree to it and to automatic monthly renewal. We record the accepted agreement version, account, plan, payment environment, and acceptance time. Acceptance is not proof that you understood every provision; ask for independent advice if you are uncertain.
5. Cancel anytime; no refunds or prorated refunds
If you are dissatisfied, you may cancel your monthly subscription at any time from My Account using Cancel Monthly Renewal. A confirmed cancellation automatically stops future automatic monthly renewals and recurring billing for that subscription. Cancellation takes effect at the end of the billing period you have already paid for, and access continues through that period. Cancel before the next renewal is processed to avoid the next period’s charge. A cancellation confirmation is shown after the request succeeds.
No refunds will be issued for past billing periods. No prorated refunds will be issued for the unused remainder of the billing period in which cancellation is requested. Dissatisfaction, nonuse, or cancellation does not entitle you to a refund. One-time purchases are also nonrefundable once access is provided. These provisions do not override refunds, cancellation rights, protections for unauthorized charges, or other rights that cannot lawfully be waived, or any mandatory payment-provider protections. Nothing here requires you to waive a valid statutory payment dispute.
6. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED ‘AS IS’ AND ‘AS AVAILABLE,’ WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY REPORT OR RECOMMENDATION WILL DELIVER A PARTICULAR LEGAL, FINANCIAL, OR OPERATIONAL RESULT. YOU USE AND RELY ON THE SERVICE AT YOUR OWN RISK, SUBJECT TO RIGHTS THAT APPLICABLE LAW DOES NOT ALLOW TO BE EXCLUDED.
7. Release and limitation of legal and financial liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE THE SITE OWNER, ADMINISTRATOR, OPERATOR, AND THEIR EMPLOYEES AND AGENTS FROM LEGAL AND FINANCIAL CLAIMS ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE, REPORTS, OR RECOMMENDATIONS, INCLUDING ERRORS, OMISSIONS, INACCURATE ESTIMATES, AI MISTAKES, OR YOUR BUSINESS DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESE PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, BUSINESS, OPPORTUNITIES, GOODWILL, OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, THEIR TOTAL AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE DURING THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
These protections apply regardless of the legal theory asserted, but do not exclude or limit liability for fraud, intentional misconduct, gross negligence, or any other liability or consumer right that cannot be excluded or limited under applicable law. No agreement can guarantee immunity from every legal or financial claim. Where a limitation is unenforceable, it applies only to the extent the law permits.
8. Indemnification
To the extent permitted by law, you agree to indemnify and hold the site owner, administrator, operator, employees, and agents harmless from third-party claims, damages, and reasonable costs arising from your unlawful use, unauthorized data submissions, violation of these terms, or implementation of outputs contrary to the review obligations above. This obligation does not apply to the extent a claim results from our fraud, intentional misconduct, gross negligence, or another responsibility that cannot legally be transferred to you.
9. Changes, termination, and general provisions
We may suspend access for unlawful use, security risks, or material breach, subject to applicable law. Material changes to this agreement will be disclosed prospectively; where required, we will request renewed consent. Changes will not retroactively eliminate accrued rights. The version you accept governs that acceptance unless lawfully amended.
Applicable law governs these terms, including any mandatory protections in your jurisdiction. If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver. These terms constitute the agreement concerning the Service, subject to mandatory law and any expressly agreed written terms. Save or print this agreement for your records.
